Categories of Personal Information We Collect About You

Personal information is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual or household.   • Demographic information, which may include protected characteristics under state or Federal law, such as age, date of birth, gender, or disability status.

  • Commercial information, including records of personal property and products or services that you purchased, obtained, or considered.
  • Internet or other electronic activity information, such as browsing history, search history, and information about your interactions with the Services.

We collect personal information about you from the following sources:

Cookies

The InControl website uses “cookies” and similar web tracking technologies to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a webpage server. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you. You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the InControl services or websites you visit.

Do Not Track

Some web browsers may transmit “do-not-track” signals to the websites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. Because there currently is no industry standard concerning what, if anything, websites should do when they receive such signals, InControl currently does not take action in response to these signals. If and when a final standard is established and accepted, we will reassess how to respond to these signals.

How We Use Personal Information

We use information that we collect about you or that you provide to us, including any Personal Data:

  • To present our Websites and their contents to you.
  • To provide you with information, products, or services that you request from us.
  • To maintain or improve our products, services, and the Websites.
  • To provide you with notices about your account, including expiration and renewal notices, invoices, and receipts.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

How We Disclose Personal Information

We do not share, sell, or otherwise disclose your Personal Data for purposes other than those outlined in this Privacy Policy. However, we may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose Personal Data that we collect or you provide as described in this privacy policy:

  • to contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep Personal Data confidential and use it only for the purposes for which we disclose it to them. Specifically, these entities provide IT and infrastructure support services and payment processing services.   • To law enforcement, government agencies, courts, or other third parties to protect ourselves, our employees, or others, to investigate fraud, or as required by law, such as to comply with a subpoena or similar legal process
  • To third parties in the event we are involved in a merger, acquisition, or sale of all or a portion of our assets, or in the unlikely event of bankruptcy; and
  • To any other third party with your prior consent

Choices About How We Use and Disclose Your Information

We do not control the collection and use of your information collected by third parties described above in Disclosure of Your Information. When possible, these organizations are under contractual obligations to use this data only for providing the services to us and to maintain this information strictly confidential. These third parties may, however, aggregate the information they collect with information from their other customers for their own purposes.

Your Privacy Choices and Rights

You may have certain choices and rights regarding our processing of your personal information under applicable data privacy laws, including if you are a California, Colorado, Connecticut, Utah, or Virginia resident. These rights may include:

  • request a copy of your personal information;
  • correct the personal information we hold about you;
  • request deletion of your personal information;
  • opt-out of “sharing” of personal information for “cross-contextual behavioral advertising” purposes (as these terms are defined under applicable law);
  • opt out of targeted advertising;
  • opt out of certain profiling activities;
  • ask that we provide your personal information in a format that would facilitate its transfer to another organization, or to you, in certain circumstances (referred to as the right to data portability);
  • not be unlawfully discriminated against for exercising your rights;

These rights may be limited or denied in some circumstances under applicable local law. If we deny a request, we will explain why in accordance with applicable local law.

Upon receipt of your request, we will ask you to provide certain personal information to verify your identity, such as your name, email address, telephone number, zip code, and/or purchase history, in order for us to determine if your information is in our systems and to verify your identity. We will verify and respond to your request consistent with applicable law. This may require that we request additional information from you to protect against fraudulent rights requests. To the extent we request such information from you, we will not use this information for purposes unrelated to verifying your identity. Please note that, to the extent you are an authorized personal representative seeking to exercise rights on behalf of someone else (where permitted by local law), we may request that you provide us with documentation regarding your authority under such applicable law and we also may seek additional verification directly with the individual whose rights are being exercised.

Data Retention

Incontrol will retain your personal data for the entire time that you keep your account open. After you close your account and request your information to be deleted, we may retain your Personal Data:

  • for as long as necessary to comply with any legal requirement;
  • on our backup and disaster recovery systems in accordance with our backup and disaster recovery policies and procedures;
  • or as long as necessary to protect our legal interests or otherwise pursue our legal rights and remedies; and
  • for data that has been aggregated or otherwise rendered anonymous in such a manner that you are no longer identifiable, indefinitely.

Security of Your Information

We have implemented measures designed to secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Websites, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Websites like message boards or Knowledgebase. The information you share in public areas may be viewed by any user of the Websites.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Data, we cannot guarantee the security of your Personal Data transmitted to our Websites. Any transmission of Personal Data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Websites.

Third Party Websites/Applications

Our Websites may contain links to other websites/applications and other websites/applications may reference or link to our Websites. These third-party services/Websites are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen or approve, and are not responsible for the privacy practices or content of such other websites or applications. Children’s Information

Our Websites are not intended for children under 18 years of age. No one under age 18 may provide any information to or on the Websites. We do not knowingly collect Personal Data from children under 18. If you are under 18, do not register on the Websites, make any purchases through the Websites, use any of the interactive or public comment features of our Websites, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received Personal Data from a child under 18 without verification of parental consent, we will delete that information. Changes to Our Privacy Policy

We continue to review our policies and procedures to assure they are effective in meeting our commitments to our Users. Accordingly, we may change this Privacy Statement from time to time.
